Description of BNSS Section 321 - Execution of commissions

  • Upon receipt of the commission, the Chief Judicial Magistrate or Judicial Magistrate as he may appoint in this behalf, shall summon the witness before him or proceed to the place where the witness is, and shall take down his evidence in the same manner, and may for this purpose exercise the same powers, as in trials or warrant-cases under this Sanhita.

Offence Fraudulent removal or concealment of property, of himself or any other person or assisting in the doing thereof, or dishonestly releasing any demand or claim to which he is entitled.
Punishment imprisonment of either description for a term which may extend to three years, or with fine, or with both
Cognizance Non-cognizable
Bail Bailable
Triable Any Magistrate.
