Description of BNSS Section 221 - Cognizance of offence.

No Court shall take cognizance of an offence punishable under section 67 of the Bharatiya Nyaya Sanhita, 2023 where the persons are in a marital relationship, except upon prima facie satisfaction of the facts which constitute the offence upon a complaint having been filed or made by the wife against the husband.

Offence

(a) Disobedience to an order lawfully promulgated by a public servant, if such disobedience causes obstruction, annoyance or injury to persons lawfully employed.


(b) If such disobedience causes danger to human life, health or safety, or causes or tends to cause a riot or affray.

Punishment

Simple imprisonment for 6 month, or fine of 2000 rupees, or both.


Imprisonment for 1 Year, or fine of 5,000 rupees, or both.
